Welcome to Cyberical Academy! These Terms explain the rules for using our school, in plain language. If you are under 18, please read them with a parent or guardian.
1. About these Terms
These Terms of Service (the "Terms") are an agreement between you and Cyberical LLC, a Florida limited liability company ("Cyberical LLC," "we," "us" or "our"). We run Cyberical Academy at https://cyberical.academy/ (the "Site"), including its courses, lessons, Creation Lab, Arcade and Campus community.
By creating an account, starting a free trial, subscribing or otherwise using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
2. Who can use Cyberical Academy
- You must be at least 13 years old to create an account. We do not knowingly allow anyone younger than 13 to use the Site, and we will close any account we learn belongs to someone under 13.
- If you are under 18, you may use the Site only with the permission of a parent or legal guardian. Your parent or guardian must read these Terms, agrees to them on your behalf, and is responsible for your use of the Site and for any purchases made for your account.
- Please give true information when you sign up, including your date of birth. Each account is for one person. Keep your password private, because you are responsible for what happens under your account. Tell us right away if you think someone else is using it.
3. Free lessons, free trials and subscriptions
Some lessons are free previews that anyone can open. Other schools and courses need a paid subscription. The price, and what it includes, is shown before you check out.
Payments are handled by our payment providers, Stripe and PayPal. We do not see or store your full card number. Subscriptions must be bought by an adult, or by a student with a parent's or guardian's permission.
- Free trial. Many of our schools begin with a free trial of up to 7 days. The exact length is shown before you check out. You give a payment method when you start the trial. You can cancel at any time during the trial and you will not be charged. If you do not cancel before the trial ends, your paid subscription begins and you will be charged the monthly price on the date shown at checkout and on your dashboard. We will email you a reminder about two days before your trial ends. Each person can have one free trial per school.
- Automatic renewal. Your subscription renews automatically every month and you will be charged the monthly price on each renewal date until you cancel. By subscribing, you authorize us and our payment provider to charge your payment method each month.
- Cancelling. You can cancel any time from your dashboard on the Site (using "Manage billing" or "Cancel subscription"), or by contacting us. When you cancel a paid subscription, it stops renewing and you keep access until the end of the month you have already paid for.
- Refunds. Because you can try lessons for free and cancel at any time, payments are not refundable, including for partly used months, except where the law requires a refund. If you think you were charged by mistake, contact us within 30 days and we will look into it and make it right.
- Price changes. We may change our prices. If the price of your subscription goes up, we will email you at least 30 days before the new price applies, so you have time to cancel if you wish.
- Missed payments and taxes. If a payment fails, we may pause your access until it goes through. Prices may not include taxes, which are added where the law requires.
4. The Creation Lab and AI tools
The Site includes tools that use artificial intelligence ("AI") to help you write code, build apps, games and AI agents, practice prompts and improve your writing. These tools are for learning.
- AI can make mistakes. Always check what it gives you. Do not rely on AI answers for medical, legal, financial or safety decisions.
- What you type into an AI tool is sent to the AI service provider we use, so it can create a response. Please do not type private information into AI tools, such as passwords, home addresses, phone numbers, or anyone else's personal details.
- We use automatic safety checks. We may block requests or results that break these Terms or our Community Guidelines, and we set daily limits on how much the AI tools can be used. We may change these tools and limits at any time.
- Do not use the AI tools to create anything harmful, hateful, sexual, violent, illegal or bullying, to copy other people's work, or to pretend to be a real person.
5. Your work
- You own the original work you create on the Site, such as your code, apps, games, writing and agents. Parts created by AI may not be protected by copyright in the same way as work you make yourself.
- When you share your work in the Campus community or a gallery, you give us permission, free of charge, to store, show and share it on the Site so that others can see it. This permission ends when you delete the work, except for copies we must keep for a short time for safety, backups or legal reasons. We will not use a student's name, photo or work in advertising outside the Site without permission (and a parent's or guardian's permission for anyone under 18).
- You promise that you have the right to share whatever you post, and that it does not break anyone else's rights.
6. Selling or earning from your creations
Members who are 18 or older may sell, publish or earn money from the apps, games, agents and other work they create on the Site. If you do, you are responsible for it, including following the law, paying any taxes, and following the terms of any store, platform or AI service you use. We do not promise that you will earn any money.
Students under 18 may keep their work, show it, and add it to a portfolio, but features for selling or earning money from creations are for adults only.
7. Campus community rules
Our Campus community is a place to learn and share. When you post, message or comment, you agree to follow our Community Guidelines, which you can read in the Campus. In short: be kind and respectful; no bullying, harassment, hate, threats or sexual content; do not share anyone's personal information (including your own); no spam or advertising; and do not post anything you do not have the right to share.
We may review, hide or remove content, and we may limit, suspend or close accounts that break these rules. You can report a post or a person, and you can block other members. If someone may be in danger, call 911 or your local emergency number.
8. The Arcade and play points
The Arcade includes games, and some are casino-style games that teach probability and odds. These games use play points only. Play points are not real money and have no cash value. They cannot be bought, sold, traded, or exchanged for money, prizes or anything else, and they may be reset at any time. No real-money gambling takes place on the Site.
9. Our content
The courses, lessons, videos, games, tools, designs and other content on the Site, and the Cyberical LLC and Cyberical names and logos, belong to Cyberical LLC or to the people who license them to us. While you have access, we give you a personal, non-transferable permission to use them for your own learning. You may not copy, resell, share, publish or make money from our content without our written permission.
10. Things you may not do
- Share your account or let other people use your login.
- Get around payments, locks, age checks, safety checks or usage limits.
- Hack, overload or interfere with the Site, or use bots or scripts to copy content from it.
- Break the law, or use the Site to harm, cheat or mislead anyone.
11. Ending your account
You can stop using the Site and ask us to close your account at any time. We may suspend or close your account if you break these Terms, if it is needed to protect students or the Site, or if the law requires it. If we close your account without a good reason, we will refund the unused part of your current paid month. Sections of these Terms that by their nature should continue after your account closes (such as sections 5, 9, 13, 14, 15 and 16) will continue.
12. Other services
The Site uses other companies' services, such as Stripe and PayPal for payments, AI service providers for the AI tools, and video sites for some lessons. Your use of those services may also be covered by their own terms and privacy policies. We are not responsible for services we do not control.
13. No guarantees
We work hard to make the Site useful, safe and available, but we provide it "as is" and "as available." To the fullest extent the law allows, we make no promises of any kind about the Site, including that it will always be available or free of errors, or that it will lead to any particular grade, certificate, job, income or result.
14. Limits on our responsibility
To the fullest extent the law allows, Cyberical LLC and its owners, staff and partners will not be responsible for any indirect, incidental, special or consequential losses, or for lost profits, data or opportunities, that come from your use of the Site. Our total responsibility for any claim about the Site is limited to the amount you paid us in the 12 months before the claim, or $50 if you have not paid us anything. Some places do not allow these limits, so they may not all apply to you.
If you are an adult and you break these Terms or the law, you agree to cover the reasonable costs, including legal fees, that Cyberical LLC has because of it.
15. Disputes
These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-law rules. If you have a problem with the Site, please contact us first, and we will try to solve it with you informally within 30 days. If we cannot, either of us may bring the matter in the state or federal courts located in Florida, and you and we agree to those courts' jurisdiction. Either of us may also use small-claims court where it applies.
16. Copyright complaints
If you believe something on the Site copies your work without permission, email us at montx1@proton.me with your name and contact details, a description of your work, where it appears on the Site, and a statement that you believe in good faith it is not allowed. We will review it and remove the material if appropriate.
17. Changes to these Terms
We may update these Terms from time to time. When we do, we will post the new version on this page and change the date at the top. If a change is important, we will also let you know by email or on the Site before it takes effect. If you keep using the Site after the change takes effect, you agree to the updated Terms.
